Job Title: Compliance Officer
Division: Regulatory and Environmental Affairs
Headquarters: Guthrie Agricultural Center, Charleston WV

Nature of Work: Under general supervision, this position provides paraprofessional support for the registrations, inspections, compliance, and enforcement programs.

Examples of Work:
  • Provide paraprofessional administrative data entry and analytics for the registrations, inspections, compliance, and enforcement programs.
  • Utilize various computer programs such as the Laboratory Information Management System (LIMS), USAPLANTS, and USAFOODSAFETY to perform data entry related to product label claims when samples of products are received for analyses.
  • Perform data entry of laboratory analyses, generate product dispositions, review results for compliance with programs under the authority of the division and assign an operational status to the manufacturer or distributor of the regulated product.
  • Evaluate submissions in accordance with applicable laws and regulations to identify issues and determine compliance or non-compliance; prepare summaries of non-compliant cases which require further review and disposition by division and department management, up to and including the Commissioner.
  • Prepare the appropriate correspondence to firms informing them of compliance or non-compliance with applicable laws and regulations; submit to proper authority for signature.
  • Prepare correspondence related to enforcement activities; submit to proper authority for signature.
  • Receive and review response plans from non-compliant firms to evaluate and determine if proposed improvement plans are acceptable remediation in accordance with applicable laws and regulations.
  • Track enforcement actions and compliance data to ensure that appropriate actions are taken at each step of the remediation and penalty processes.
  • Provide information, such as policies pertinent to the case, and testimony as needed for hearings conducted within the authority of the Department or other civil cases at the Department level; compile information relevant to appropriate disposition and penalty assessments; and prepare formal reports of resolution for dissemination.
  • Provide information and/or recommendations to the Assistant Director, Deputy Director, or Director for consideration in formulating and/or implementing compliance programs.
  • Assist with compiling information and composing drafts and/or amendments to laws, rules, and regulations regarding division programs as needed.
  • Prepare and submit information for annual reports and similar documents pertaining to programs for submission to the Assistant Director.
  • Participate in professional meetings, conferences, and other community programs designed to coordinate the agency's goals and activities with those of other organizations if necessary.
  • Assist with the upkeep, program problem identification, and testing of LIMS, USAPLANTS, and USAFOODSAFETY online computer programs; work with all persons necessary to correct any identified problems and keep the systems functional.
  • Collect pricing information from industry firms annually to be used for re-calculation of penalties as necessary.
  • Other duties as assigned.
Working Conditions: Sit, stand, and/or walk for extended periods; frequently bend, squat, reach above shoulder level, push, pull, and lift up to 50 pounds.

Knowledge, Skills, and Abilities:
  • Knowledge of laws, rules, and regulations relevant to the area of assignment.
  • Knowledge of standards and practices in business matters and public administration.
  • Ability to comprehend, interpret, and apply laws and regulations in work products.
  • Ability to evaluate operational situations, analyze data and facts, and provide information to management for decision making process.
  • Ability to establish and maintain effective working relationships with peers, management, other agencies' staff, and the public.
  • Skilled in presenting ideas effectively, both written and verbal.
  • Skilled in the use of a computer and various software applications.
Minimum Qualifications:
Education: Graduation from an accredited college or university with a Bachelor's degree in a field directly related to the area of assignment.
Experience: Two years of full-time paid employment in areas of agricultural inspections and related compliance issues.

Additional Requirements:
  • Valid driver's license.
  • Satisfactory completion of pre-employment drug testing.
  • Satisfactory completion of pre-employment law enforcement background investigation, including fingerprinting and DMV records.
  • Must maintain a positive image of the Commissioner, West Virginia Department of Agriculture, and the State of West Virginia.
