National Boutique Law Firm seeking qualified attorney(s) to remotely represent students, faculty, and staff in various school proceedings, both disciplinary and non-disciplinary in nature, with a creative problem-solving approach.

(No travel is required with this position as all work will be done virtually / remotely. The attorney can work from anywhere preferred.)

Candidates MUST have at least 3 years experience as a practicing attorney. Candidates should have education law experience and/or experience in the education field prior to becoming an attorney.

The following is a broad overview of the nature of the causes with which we help clients in all 50 U.S. states and beyond (Caribbean medical schools, etc.).

Most representation is at the higher education level and up, including at professional schools and programs (medical schools and medical residencies; dental schools; etc.), with a respectable amount of representation of high school and K-12 students.

Proceedings will include:

- Disciplinary matters involving academic misconduct and general misconduct, Title IX sexual harassment / sexual misconduct, etc.

- Non-disciplinary matters involving academic progression issues, failure to meet satisfactory academic progress, and dismissals for academic reasons; a school's failure to provide accommodations under the Americans with Disabilities Act (ADA); students' disabilities affecting their academics; special education / 504 cases; etc.

Proceedings, both disciplinary and non-disciplinary in nature, can involve overlapping issues, including ADA issues; discrimination under Title VI, VII, etc.; employment law (in matters involving faculty and staff); constitutional rights; and various other federal and state laws.

The vast majority of work will entail (remotely) working within the process and policies of the school at the school level in an effort to achieve a positive constructive resolution for the client.

If there are violations of federal and/or state law, the ideal candidate will be able to address the matter in the applicable court as needed. Federal bar admission, and ready ability to seek pro hac admission as needed is preferred. (Being able to take applicable matters to court to seek recourse on behalf of a client is preferred, but not required, as such matters can be referred out as needed, and the focus of representation is trying to favorably the case at the school level without the need to have to take a matter to court.)

The ideal candidate will have prior trial experience, although this role will largely involve remote representation of students (and faculty and staff secondarily) at the school level in an administrative advisory capacity through the school process.

The ability to write and draft necessary submissions, responses, and so forth, to a school as part of the standard course of school-level proceedings is important.

The ability to effectively discuss and negotiate proposed reasonable outcomes on behalf of clients with a school's Office of General Counsel (the school's attorney) is important, as cases at times will not necessarily be favorably resolved via the school process, but rather, by structuring a reasonable resolution with the school's attorney at the appropriate point in the process.

The attorney will not be involved with initial client intake, but will be involved and will take the lead during the initial phone consultation with a client. The attorney will be responsible for client representation beyond the stage of a consultation from start to case conclusion. Consultations, which are high in volume, may take place during weekday evenings and on Saturdays and potentially Sundays, so the ability to be available during said days and times is important.

(The most important consideration with regards to the attorney's availability for consultations is ready availability through the week. The specific days and times are of less importance, and consultations themselves can be scheduled at the attorney's convenience as long as there is sufficient and ready availability through the week.)

The position allows a flexible schedule and work on the client's case itself can be done at the candidate's convenience as long as any deadlines and expectations related to the case and client are met. The only case scheduling requirements would be that the candidate has to be available for scheduled school proceedings related to a case, such as meetings, interviews, hearings (if they are to take place), and so forth. Most school proceeding scheduling can be done in coordination with the candidate's schedule and availability to a certain degree.
