Job Title: Administrative Hearing Officer

Job Summary:

FAR GROUP is currently seeking the professional services of an interested individual to serve as an Administrative Hearing Officer in Prince Gorge's County. With the increase in administrative citations, delays may come about regarding the speed at which a hearing is held, time in which a decision is issued, defaults are mailed, and the overall timing of the adjudication process, which is intended to be quick. Administrative Hearing Officers are a vital component of AHU operations. To address this critical need, DPIE is seeking Administrative Hearing Officers to hold hearings, issue decisions, and respond to motions.

Requirements:

This service is for a non-supervisory professional attorney work involving legal writing and research, analytical skills, and presiding over administrative hearings relating to property standards, unpermitted construction, short term rental, and zoning cases. Other types of citations may be added to this list, as needed.

Administrative Hearing Officers must independently review cases based on the facts presented in writing or verbally and issue decisions in accordance with the county code, regulations, code amendments, operating manuals, and procedural guides.

The cases assigned may involve unique legal arguments, some novel or lack in precedent. The Hearing Officer must closely analyze the facts to determine appropriate legal courses of action. Many legal issues contain uncertainties and unknowns, which call for seasoned judgment acquired through years of experience.

Duties:

· Review case records and conducts in-person and virtual hearings in an orderly and impartial manner.

· Commence administrative hearing and advise respondents of their rights.

· Determine the credibility of witnesses, evaluate evidence, and apply relevant rules, regulations, and court decisions.

· Prepare concise written statements of facts, conclusions of law, and appropriate orders.

· Determine outcomes of motions to vacate the judgment for failure to appear.

· Evaluate and decide procedural questions regarding the consolidation of issues, prima facie case issues, and the admission of evidence into the hearing record.

· Question respondents, witnesses, and DPIE representatives to elicit facts necessary to render fair and legally sound decisions.

· Ensure the questioning of all parties is conducted in a fair, impartial, and even-handed manner.

· Guide the course of each hearing to produce a clear, concise, and relevant record.

· Render a decision based on fact-finding and applicable law.

· Maintain subject knowledge of current and new regulations to ensure compliance with the judicial and administrative requirements.

· Review and approve consent/settlement agreements with Respondents and Inspectors to expedite the hearing process and ensure compliance with pending cases.

· As assigned, participates remotely in meetings, trainings, workgroups, and taskforces formed to deal with Administrative Hearing Unit operations/issues; and participates in discussions, presentations, and report writing resulting from such activities.

· Perform other related duties as assigned.

Knowledge, Skills, and Abilities:

· Currently hold a Juris Doctor from an American Bar Association approved law school

· Experience practicing law; litigation experience preferred

· Knowledge of applicable County Codes, statutes, and regulations related to property standards, unpermitted construction, short-term rental, and zoning.

· Knowledgeable of administrative law procedures and/or have prior experience as a mediator or hearing official.

· Ability to remotely work when necessary to hold hearings.

· Ability to prepare written legal decisions based on sound legal jurisprudence.

Qualifications:

· Juris Doctor (J.D.) from an ABA approved Law School

· Experience as an Administrative Hearing Officer with specialized experience adjudicating property standards, unpermitted construction, and zoning administrative matters

· Knowledgeable about the rules of evidence – preferred five (5) years

· Familiarity with DPIE’s Administrative Hearing and Appeals process in accordance with the job description, and/or Admin hearing rules/procedures (Subtitle 13, Division 15, Subtitle 4 Division 1, Subtitle 5 Division 8 and Subtitle 13 of the County Code)

· Excellent legal writing and research skills, demonstrated by examples submitted
