DISTINGUISHING FEATURES OF THE CLASS: An employee in this class assists the County Public Defender in representing, without charge, by order of a court, each indigent petitioner or respondent seeking relief under the Family Court Act of New York State and related statutes. When representing an indigent litigant, the incumbent counsels, advises and appears before the Court at each and every stage of the proceedings to ensure the client’s interests are protected. The work is performed under guidelines provided by law under the general direction of the Public Defender. Supervision is exercised over sub-professional, technical and clerical employees. Does related work as required.

TYPICAL WORK ACTIVITIES:

Represents indigent clients in custody, visitation, family offence, support violations and abuse/neglect proceedings;

Reviews petitions, court filings and related case records at inception of case;

Conducts client interviews, including in person meetings, and maintains regular communication with clients, including timely responses to client queries;

Appears in Family Court on a daily basis, on a range of proceedings, including arraignments, settlement conferences, emergency hearings and contested trials;

Engages in active settlement negotiations with opposing counsel;

Engages in frequent trial practice, including preparing witness testimony, engaging expert witnesses, reviewing physical evidence and preparing exhibits, researching applicable case law, and drafting opening and closing statements;

Conducts legal research and drafts legal writing, including cross-petitions, motions, subpoenas, interrogatories and other evidentiary tools;

Communicates legal principles to clients to ensure their understanding of settlement offers, legal consequences and legal principles;

Maintains comprehensive and detailed case files documenting all case communication and court proceedings;

Supervises sub-professional, technical and clerical employees.

FULL PERFORMANCE KNOWLEDGES, SKILLS, ABILITIES AND PERSONAL

CHARACTERISTICS: Thorough knowledge of the principles and practices of Family law and Social Services law as applicable; thorough knowledge of Family Court procedures and the rules of evidence; good knowledge of the New York Rules of Professional Conduct; skill in trial preparation for custody, support, negligence and abuse matters; skill in the preparation of petitions, motions, briefs and related legal documents; ability to analyze, appraise and apply legal principles, facts and precedents to legal problems; ability to communicate and negotiate effectively; good professional and administrative judgment.

MINIMUM QUALIFICATIONS Admission to the Bar of the State of New York.

Note 1: Experience in trial, with Family Court practice preferred.

Note 2: Must provide a current certificate of good standing.

Special Requirement for appointment to Ulster County positions: Upon a conditional employment offer and in accordance with Ulster County Legislative Local Law Number 14 of 2007 or by other State and Federal Statutes, prospective candidates for employment to all Ulster County positions must obtain clearance for appointment from the Department of Criminal Justice System or other mandated Federal and State regulatory authorities. Such prospective candidates will be required to be fingerprinted accordingly.
