The purpose of the class to be responsible for the management of all functions of the Probate Court specifically targeted to the Estate Division. Serves as liaison between public, attorneys, any other office or interested party to an Estate proceeding and the judges; and is ultimately responsible for management of all Estate files. The class works within broad policy and organizational guidelines, does independent planning and implementation and reports progress of major activities through periodic conferences and meetings with the Clerk of Probate and with the judges.

Duties

ESSENTIAL JOB FUNCTIONS
  • Conducts initial review of all Estate proceedings commenced, in order to probate the assets of a deceased person. If the initial filing is accurately done and in compliance with the legal requirements, then the case is opened in the specialized Probate Court Case Management System (ICON). Enter relevant information accurately into ICON to ensure time requirements are met and to correctly capture all necessary information.
  • Assists with Motions, Petitions, special requests, or other filings.
  • Reviews standard and required filings for accuracy and legal standards. Ensure Accounting is consistent with prior filings, bank statements, expenditures, etc. Ensure that funds are being properly distributed through knowledge of Title 62.
  • Reviews uncustomary pleadings and determine if they are legally and proper.
  • Prior to closing the Estate review file to ensure that all funds have been allocated properly, all disbursements were authorized, and all takers receive the correct asset or amount of funds.
  • Notify Personal Representative (PR) of errors requiring correct or prepare the file for a Rule to Show Cause as to why the PR should not be held in contempt of court.
  • For litigated and contested matters that arise during the pendency of the Estate, work with the attorneys, the parties, and the judges to ensure the file is prepped for the Court Hearing. Ensures the PR complies with the terms and requirements of the Court Order.
  • Coordinates with the Therapeutic Clerk (If a taker in an Estate is a Minor under the age of 18) to make sure that the PR or someone establishes a Minor Conservatorship in order to disburse the funds into it from the Estate. Ensures compliance with applicable law on this transition.
  • Responsible for accurately scanning every document into ICON, properly naming each document, and filing all documents in the hard copy of the file.
  • Responsible for ensuring certain time limits are met by reviewing files and sending out late letters, status letters, or letters for additional filings that are needed.
  • Coordinates and monitors Probate Court cases for trial; ensures files are summarized and placed on the dockets as required.
  • Enters and maintains accurate records in court software.
  • Explains probate policies and procedures to attorneys, families, Personal Representatives, etc.; assists family members and others in completing required forms and court documents.
  • Interviews and meets with families to gather information and complete the proper pleadings.
  • Evaluates documents submitted to the Court for completeness, accuracy and validity.
  • Plans, organizes, directs, guides, coordinates and participates in the administrative and clerical functions of the Probate Court in accordance with applicable policies, procedures, laws and regulations.
  • Keeps judges informed concerning work progress, policy concerns or public complaints.
  • Prepares and sends out new packages and closing packages.
  • Reviewing all Inventory and appraisements; issues appropriate bill; reviews and grants/denies Motions of Extension; and assists with title searches.
  • Establishes, maintains and closes case files; gathers and verifies all supporting documentation.
  • May attend and assist with emergency mental health hearings, chemical dependency hearings, judicial alcohol/drug hearings and judicial mental health hearings.
  • May attend, prepare and issue court orders, detention orders, judicial commitment records and orders pertaining to the appointment of physicians, attorneys and guardian ad litem.
  • Processes marriage applications; issues marriage certificates.
  • Collects fees; makes deposits, counts the money drawer for deposits to the Treasurer, and prepares reports to send deposits to the Treasurer.
  • Performs routine clerical work as required including, but not limited to, answering the telephone, typing reports and correspondence, copying and filing documents, sending and receiving faxes, assembling materials, processing mail, etc.
  • Receives and responds to inquiries, concerns, complaints and requests for assistance regarding areas of responsibility.
  • Attends training, seminars, workshops, etc., as required, to maintain job knowledge and skills.
  • Performs other related job duties as assigned.
